kecurangan - kecurangan perusahaan
Contoh kasus di dalam negeri, kita
diingatkan oleh Freeport dengan perusakan lingkungan. Masyarakat dengan
mata kepala sendiri menyaksikan tanah airnya dikeruk habis. Sehingga
dampak dari hadirnya Freeport mendekatkan masyarakat dari
keterbelakangan. Kalaupun masyarakat menerima ganti rugi, itu hanyalah
peredam sesaat, karena yang terjadi justru masyarakat tidak banyak
belajar dari usahanya sendiri. Masyarakat terlena dengan ganti rugi tiap
tahunnya, padahal dampak jangka panjangnya sungguh luar biasa.
Masyarakat akan semakin terpuruk dari segi mental dan kebudayaannya akan
terkikis. Juga dalam beberapa tahun ini, tentunya kita masih disegarkan
oleh kasus lumpur Lapindo. Kita tahu berapa hektar tanah yang terendam
lumpur, sehingga membuat masyarakat harus meninggalkan rumahnya. Mungkin
bisa jadi ada unsur kesengajaan di dalamnya. Demi peningkatan profit
yang tinggi, ada hal yang perlu dikorbankan, tentunya tidak lain
masyarakat itu sendiri. Kita juga masih ingat akan kasus Teluk Buyat
yang menyebabkan tercemarnya lingkungan tersebut. Yang cukup
menghebohkan mungkin kasus Marsinah, seorang buruh yang memperjuangkan
hak-haknya, tetapi mengalami peristiwa tragis yang membuat nyawanya
melayang.
Semua itu terjadi karena tidak
diterapkannya etika dalam berbisnis. Di dalam etika itu sendiri
terkandung penghargaan, penghormatan, tanggungjawab moral dan sosial
terhadap manusia dan alam. Kalau kita melihat lebih jauh tentunya ada
dua kepentingan, baik dari perusahaan dan masyarakat yang perlu
diselaraskan. Di dalamnya terkandung juga hak dan kewajiban yang harus
terpenuhi. Coba mari kita renungkan bersama, bukankah tidak
diterapkannya etika dalam berbisnis justru akan menjadi bumerang
bagi perusahaan tersebut? Mungkin akan banyak biaya yang dikeluarkan
untuk menyelesaikan kasus serta citra perusahaan di masyarakat luas
semakin miring. Hal ini justru akan sangat merugikan perusahaan itu
sendiri.
Belum lagi kasus yang terjadi di luar
negeri. Sebagai contoh adalah kasus asuransi Prudential di Amerika.
Belum lagi skandal Enron ,Tycon, Worldcom dsb. Banyaknya kasus yang
terjadi membuat masyarakat berpikir dan mulai menerapkan etika dalam
berbisnis. Apalagi sekarang masyarakat mulai membicarakan CSR (Corporate
Social Responsibility). Apa itu? Dalam artikel yang ditulis oleh
Chairil Siregar disebutkan CSR merupakan program yang harus dilaksanakan
oleh perusahaan sesuai dengan undang-undang pasal 74 Perseroan
Terbatas. Tentunya dengan adanya undang-undang ini, industri maupun
korporasi wajib melaksanakannya, tetapi kewajiban ini bukan merupakan
beban yang memberatkan. Salah satu contoh yaitu komitmen Goodyear dalam
membangun masyarakat madani, ekonomi, pendidikan, kesehatan jasmani,
juga kesehatan sosial. Kepedulian ini sebagai wujud nyata peran serta
perusahaan di tengah masyarakat. Perlu diingat pembangunan suatu negara
bukan hanya tanggungjawab pemerintah dan industri saja tetapi setiap
insan manusia berperan untuk mewujudkan kesejahteraan sosial dan
kualitas hidup masyarakat

konflik yang terjadi dalam bisnis
Konflik dilatarbelakangi oleh perbedaan
ciri-ciri yang dibawa individu dalam suatu interaksi. perbedaan-perbedaan
tersebut diantaranya adalah menyangkut ciri fisik, kepandaian, pengetahuan,
adat istiadat, keyakinan, dan lain sebagainya. Dengan dibawasertanya ciri-ciri
individual dalam interaksi sosial, konflik merupakan situasi yang wajar dalam
setiap masyarakat dan tidak satu masyarakat pun yang tidak pernah mengalami
konflik antar anggotanya atau dengan kelompok masyarakat lainnya, konflik hanya
akan hilang bersamaan dengan hilangnya masyarakat itu sendiri.
Kemudian seorang pemimpin perusahaan
atau sebuah organisasi perlu mengetahui jenis 0 jenis dari konflik tersebut.
Dalam hal ini seorang pemimpin dapat menunjuk bagian personalia dalam sebuah
perusahaan untuk mengatasi segala macam konflik yang terjadi dalam perusahaan
tersebut. Maka dari itu bagian personalia ini yang akan menjadi jembatan utama
dalam segala pertentangan yang terjadi. Jenis – jenis konflik meliputi :
a. Konflik
peranan yang terjadi didalam diri seseorang (person-role conflict).
b. Konflik
antar peranan (inter-role conflict), Konflik yang timbul karena seseorang
harus memenuhi harapan beberapa orang (intesender conflict).
c. Konflik
yang timbul karena disampaikannya informasi yang saling bertentangan
(intrasender conflict).
Konflik juga dapat dibedakan menurut
pihak-pihak yang saling bertentangan. Atas dasar hal ini , ada 5 jenis konflik
, yaitu :
A. Konflik
antar individu.(konflik ini terjadi karena adanya pertentangan antar individu).
B. Konflik
antar individu dan kelompok(konflik ini terjadi karena kesalahpahaman yang
melibatkan suatu kelompoknya).
C. Konflik
antar kelompok dalam organisasi yang sama.(konflik terjadi karena tingkat
persaingan yang di dalamnya berujung pertentangan).
D. Konflik
antar organisasi(konflik terjadi karena tidak adanya kesadaran yang melibatkan
banyak pihak).
Ketika bisnis merupakan pemikiran atau
refleksi tentang moralitas dalam ekonomi atau bisnis dan semua pihak yang
terkait dengan para kompetitor untuk menghindari penyimpangan-penyimpangan ilmu
ekonomi dan mencapai tujuan atau mendapatkan profit, sehingga kita harus
menguasai sudut pandang ekonomi, hukum, dan etika atau moral agar dapat
mencapai target yang dimaksud. Moralitas berarti aspek baik atau buruk, terpuji
atau tercela, dan karenanya diperbolehkan atau tidak, dari perilaku manusia.
Moralitas selalu berkaitan dengan apa yang dilakukan manusia, dan kegiatan
ekonomis merupakan suatu bidang perilaku yang sangat penting. Tetapi belum
pernah etika bisnis mendapat begitu banyak perhatian seperti sekarang.
Etika bisnis dalam perusahaan memiliki
peran yang sangat penting, yaitu untuk membentuk suatu perusahaan yang kokoh
dan memiliki daya saing yang tinggi serta mempunyai kemampuan menciptakan nilai
(value-creation) yang tinggi, diperlukan suatu landasan yang kokoh. Biasanya
dimulai dari perencanaan strategis , organisasi yang baik, sistem prosedur yang
transparan didukung oleh budaya perusahaan yang andal serta etika perusahaan
yang dilaksanakan secara konsisten dan konsekuen.- CONTOH KASUS: Contoh kasus yang paling sering diperbincangkan dan tidak menemui titik terang adalah kasus Bank Century.Seperti kita ketahui bahwa dari kasus bank century yang pailid yang mengakibatkan banyak nasabahnya mengalami kerugian dengan kehilangan uang mereka yang mereka tabungkan di Bank Century. dalam hal ini jelas konflik tersebut sangat merugikan nasabah, karna pihak Bank Century sendiri pun tidak serta merta bertanggung jawab atas kehilangan atau kerugian yang dialami oleh para nasabahnya. tidak ada ganti rugi yang diberikan oleh pihak Bank Century.Kasus ini semakin menjadi perbincangan dimasyarakat karena nasabah bank tersebut, uangnya semakin tidak jelas, dalam arti tidak bisa kembali.Kasus Bank century yang kini berubah naman menjadi bank mutiara sarat dengan politik, dimana sekarang Kebenaran politik bergantung siapa berkuasa, kebenaran hukum bergantung debat pasal dan kebenaran obyektif ditentukan dasar teori dan bukti empiris.
- ANALISIS: Kasus bank century atau telah berubah nama menajdi bank mutiara telah menjadi kasus yang dibuat pelik dan seakan tidak ada ujungnya. Satu hal lagi dalam selain konflik, kasus ini juga mengandung unsur korupsi dan sarat dengan kepentingan politik.Secara etika jelas sekali melanggar, karena mereka melakukan hal – hal yang tidak boleh dilakukan dalam hal ini membawa kabur uang nasabah. Akibat dari itu maka terjadi konflik antara nasabah dengan bank.Saat ini nasabah hanya minta satu hal yaitu kejelasan atas uangnya.
